DMCA Policy

Sweet Peach Iced Tea respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We also may, at our sole discretion, limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Filing a DMCA Infringement Notice

If you believe that any content on the Sweet Peach Iced Tea website or services infringes upon your copyright, you may send us a notice requesting that the content be removed or access to it be disabled. Please be aware that you may be held liable for damages (including costs and attorneys' fees) if you materially misrepresent that content or activity is infringing your copyrights. To be effective, your notice must be a written communication that includes substantially the following:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed.

Filing a DMCA Counter-Notification

If you believe that material you posted on the Sweet Peach Iced Tea website or services was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. Please be aware that you may be held liable for damages (including costs and attorneys' fees) if you materially misrepresent that content or activity is not infringing the copyrights of others. To be effective, your counter-notification must be a written communication that includes substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Sweet Peach Iced Tea may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
